Terms of use
The terms that govern your use of this website.
1Overview
These Terms of Use (“Terms”) govern your use of the Essington Institute website and any material we publish through it. The website is operated by Essington Institute Limited (ACN 700 309 459), a company limited by guarantee (“the Institute”, “we”). By using the website you agree to these Terms. If you do not agree, do not use it.
2What this website is
The Institute publishes information, analysis, and guides about national preparedness. Everything on this website is provided for general information. It is not legal, financial, medical, engineering, or safety advice, and it is not a substitute for official warnings and directions from emergency services, police, health authorities, or government.
In an emergency, follow the instructions of the relevant authorities. Call Triple Zero (000) if life or property is in danger.
3Accuracy of information
We work to make sure every figure we publish is sourced and current, and we cite those sources. Even so, to the maximum extent permitted by law we make no representation or warranty as to the accuracy, completeness, currency, or suitability of any information on this website. Content may be added, amended, or withdrawn at any time without notice. You are responsible for evaluating any information before relying on it.
The shipping map on our home page is an illustration built from modelled and historical traffic data. It is not a live feed and must not be relied upon for navigation or any operational purpose.
4Intellectual property
Unless otherwise stated, the material on this website — text, designs, code, data compilations, and the Essington Institute name and mark — is owned by the Institute or its licensors. You may read, print, and share our published guides for personal and non-commercial community use, with attribution. Any other reproduction, distribution, or adaptation requires our prior written consent.
Third-party data we cite remains the property of its publishers and is used in accordance with their terms.
5Content you send us
If you send us feedback, suggestions, or other material, you grant the Institute a perpetual, worldwide, non-exclusive, royalty-free licence to use it for our purposes without payment or credit. You keep ownership of what you send. You warrant that it does not infringe anyone else’s rights or contain unlawful material, and you accept that we are not obliged to use, respond to, or keep it confidential.
6Acceptable use
You must not:
- Use the website for any unlawful purpose;
- Attempt to gain unauthorised access to the website, its hosting, or any connected system;
- Introduce malicious code or interfere with the website’s operation;
- Scrape, copy, or use the website’s content to develop, train, or refine artificial intelligence or machine learning models without our express written permission; or
- Misrepresent yourself or your affiliation when you contact us.
7Third-party links
The website links to other websites, including the sources we cite. We do not control them and are not responsible for their content or policies.
8Liability
The website is provided “as is” and “as available”. To the maximum extent permitted by law, the Institute excludes all warranties and accepts no liability for any loss or damage arising from your use of, or reliance on, the website or its content. Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.
9Indemnity
You agree to indemnify the Institute against any claim or loss arising from your breach of these Terms or your unlawful use of the website.
10Privacy
Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.
11Changes and termination
We may change these Terms, and may change, suspend, or withdraw any part of the website, at any time. Changes take effect when posted. Your continued use of the website is acceptance of the revised Terms.
12Governing law
These Terms are governed by the laws of the Australian Capital Territory and the Commonwealth of Australia. You submit to the exclusive jurisdiction of the courts of the Australian Capital Territory.
